Terms and conditions

Application of conditions: 

All goods sold by The Beach Hut (“we”, “us”, “the company”) are sold under these conditions unless otherwise clearly stated in writing under a separate contract. These conditions will apply to the exclusion of any terms or conditions put forward by the customer. No conduct by us will be deemed to constitute the acceptance of any terms and conditions other than these conditions.

Price lists and sales literature:

The price of the products will be the price quoted in the Web Site at the time we accept your order. The price will include any applicable value added tax, but not the cost of delivery.

Prices given in our website or other sales literature are for information purposes only, and do not constitute an offer. No contract will come into existence until the customer’s order (however given) is accepted.

We reserve the right to make changes to our products and the price and availability is also subject to change, without notice.

Delivery:

The delivery charges are as shown in the Web Site at the time we accept your order – unless you qualify for free delivery. The amount of these charges varies according to the method of delivery and the delivery address you specify in your order.

Any dates quoted for delivery are approximate only. We will use reasonable endeavours to effect delivery on agreed dates based on information available at time of quoting. We accept no responsibility for any loss resulting from delays to delivery.

Payment:

Payment is due at the time of ordering, and can be made by an acceptable payment card via PayPal secure transaction. The payment cards which are acceptable are listed in the Web Site. Alternatively, you may telephone 01736 711 116 or email us with your order at sales@beachut.co.uk

Ownership of goods:

Goods remain the property of The Beach Hut until paid for in full.

Cancellations:

Should you wish to cancel your order please email us at sales@beachut.co.uk or call our Customer Service Team on 01736 711 116. As long as your order has not been dispatched we will issue a full refund to your original payment card. You may cancel your order by notifying us in writing at any time up to 14 days after your products have been delivered.

Damaged or Faulty Goods:

If you receive damaged or defective goods, or short order, please contact our Customer Service Team on 01736 711 116 to claim a refund or replacement. Damaged or defective goods must be returned within 14 days of receipt to The Beach Hut, Market Place, Marazion, Cornwall TR17 0AR. Upon receipt of the returned goods we will issue a full refund, including postage costs, to your original payment card.

Returns & Refunds:

You may exchange or have a refund on all goods, providing the seal is still intact, goods unopened and in a re-saleable condition. Please contact our Customer Service Team first on 01736 711 116 to arrange a return. Unwanted items should be returned to the above address within 7 days of receipt. Please include a reason for return and a contact telephone number. Once we have confirmed the returned goods are in a re-saleable condition we will issue a refund to your original payment card. Cost of postage will not be refunded.
In the unlikely event that you dislike or experience a reaction to one of our products, please call our Customer Service Team on 01736 711 116.

Storage:

We will be under no liability for any defect in the goods arising from incorrect storage by the customer. Our products containing essential oils should be stored in a cool place, out of direct sunlight, and out of sight and reach of children.

Out of Stock & Seasonal Shortages:

While every effort is made to keep our complete range of products in stock, we do not accept any responsibility for loss resulting from any out of stock items.

Product suitability:

Our products are used for a wide variety of purposes. It is the responsibility of the customer to ensure the products are appropriately used. All representations, warranties, conditions or terms relating to fitness for purposes, are excluded to the fullest extent permitted by law and we accept no liability.

Customers should satisfy themselves to the suitability of products before purchase. We make no specific claims to any reputed therapeutic value of any of our products, except in respect of our customers’ experience, testimonials, recommendations or other comments.

Please note that The Beach Hut accepts no liability for misuse of products containing essential oils or other products or for any reliance on the information provided by us via our website or other social media channels.

Web Site Information:

We do not accept liability for any loss (direct, indirect or consequential) which may arise from reliance on information contained in the Web Site or in respect of any error or omission.

The information provided by The Beach Hut on our website and via other social media channels is for personal information and interest only. It is not intended to offer professional medical advice or treatment for any condition.

The information is provided on the basis that there are no known contra-indications to our products, except where stated on the product, and our general warning not to use products containing essential oils in early pregnancy without qualified advice. If you have any health problems or are taking any medication you should seek advice from your healthcare provider prior to using any products containing essential oils.

The material in the Web Site is copyright to The Beach Hut. You are welcome to view, print and download the contents of the Web Site for personal use, but not for any commercial purposes or re-publication.

We have tried to ensure that information provided in the Web Site is accurate. However, we make no representation and give no warranty of any kind in respect of the information.

Force Majeure:

The company shall not be responsible for any loss to the customer resulting from delivery being affected by war, strikes, fire, changes of government policy, act of God or other circumstances beyond its control.

Consequential Loss:

In no event will the company be under any liability whatever to the customer for any loss of profit, business, contracts, revenues or anticipated savings, or for any indirect or consequential loss and/or expense (whatever the cause, including negligence) suffered by the customer.

Insolvency of customer:

If the customer fails to make payment when due or makes any arrangements with its creditors, becomes bankrupt or goes into liquidation (or the company reasonably apprehends that any of these events is about to occur) we may in our absolute discretion suspend all further deliveries of goods and/or terminate the contract, without liability on our part.

Customer transactions:

Where the goods are sold under a consumer transaction (as defined by the Consumer Transactions (Restrictions on statements) order 1976) the statutory rights of the customer are not affected by these conditions.

Any contract between us shall incorporate these terms and conditions and be under English law. If there is any dispute, the English Courts will have exclusive jurisdiction.
